Conditions of Sale

  1. Premises

These general terms and conditions of sale (hereinafter referred to as "General Terms") regulate the purchase of products through the Gardapool.com e-commerce site (hereinafter referred to as the "Site"), owned by Gardapool s.r.l., located in Via Linfano, 52, 38062 Arco (TN), VAT number IT01959750223, registered in the Trento Companies Register.

By placing an order on the Site, the user (hereinafter referred to as the "Customer") accepts the General Terms outlined below.

  1. Products

The products available for sale on the Site are pool-related items described in their respective product descriptions. Gardapool s.r.l. reserves the right to update, modify, or remove products available on the Site without prior notice.

Product images are indicative and may not exactly match the product received by the Customer.

  1. Prices

Product prices are stated in euros (€) and include VAT unless otherwise specified. Any shipping costs will be indicated separately during the purchase process. Gardapool s.r.l. reserves the right to change prices at any time; however, the price applied will be the one stated at the time of order.

  1. Orders and Payments

An order is considered complete at the end of the checkout process, once payment has been successfully made.

Accepted payment methods include:

  • Credit/debit cards (VISA, Mastercard, etc.);
  • PayPal;
  • Other methods indicated during the purchase process.

If payment is not made, the order will be canceled.

  1. Shipping and Delivery

Products are shipped to the address provided by the Customer at the time of the order. Delivery times are indicative and may vary based on product availability and destination.

Delivery delays do not entitle the Customer to claim compensation or indemnity.

Shipping costs, if applicable, will be clearly indicated during the purchase process.

  1. Right of Withdrawal

The consumer Customer has the right to withdraw from the contract, without penalty and without giving any reason, within 14 days from the date of receipt of the products (or of the last item, in the case of split delivery), pursuant to Articles 52 et seq. of Legislative Decree no. 206/2005 (Italian Consumer Code).

Withdrawal is exercised through the dedicated "Request a return" function in the orders area of the website, or by means of an explicit statement sent to info@gardapool.com, indicating the order number and the items concerned. Gardapool S.r.l. will send confirmation of receipt of the request on a durable medium.

The products, intact, unused and complete with their labels and original packaging, must be returned within 14 days to: Gardapool S.r.l., Via Linfano, 52, 38062 Arco (TN), Italy. Return shipping costs are borne by the Customer.

The refund, including standard delivery costs, will be made within 14 days using the same payment method used for the purchase; the seller may withhold it until the goods are received or proof of their shipment is provided.

The Customer is liable for any diminished value of the goods resulting from handling other than what is necessary to verify their nature and characteristics.

Withdrawal is excluded in the cases provided for by Article 59 of the Consumer Code, including sealed products that cannot be returned for hygiene reasons once opened. The statutory guarantees of conformity (Articles 128 et seq. of the Consumer Code) remain unaffected for defective or non-conforming products.

Returns of products that do not comply with the above conditions will not be accepted.

  1. Warranty and Complaints

All products sold on the Site are covered by the legal warranty of conformity provided by the Consumer Code (Legislative Decree 206/2005).

In the event of a defective or non-compliant product, the Customer may file a complaint by sending an email to info@gardapool.com, providing a detailed description of the issue and, if possible, photographic evidence.

  1. Limitations of Liability

Gardapool s.r.l. is not liable for direct or indirect damages resulting from improper use of purchased products. It is also not responsible for delays or non-delivery caused by force majeure events (e.g., natural disasters, strikes, pandemics, etc.).
